Terms of Service

These Terms of Service (these "Terms") set out the conditions under which Tiida Tech Ltd. ("we", "us", or "our") provides the iPhone/iPad application Jimakun (Japanese name: じまくん, the "Service"). By using the Service, you (the "User") agree to be bound by these Terms.

1. Application of These Terms

These Terms apply to all interactions between Users and us in connection with the use of the Service. If we post or otherwise notify Users of any additional guidelines regarding the Service, those guidelines will form part of these Terms.

2. Description of the Service

The Service displays everyday conversations with family members who are hard of hearing as large, easy-to-read captions that fill the screen. It listens to nearby speech through the microphone and displays it as Japanese-language captions in real time.

The Service is not designed as a meeting-transcription tool, a tool for producing minutes, or a tool for fully automated speech transcription. Its purpose is to help people take part more easily in the conversation happening right now — confirming a hospital appointment, talking at the dinner table, greeting a visitor at the door — rather than to record or archive what was said. The Service is also not a hearing aid or medical device, and it does not improve hearing itself.

3. Important Notes for Use

The captions shown by the Service are a real-time, reference display generated by speech recognition. For anything where accuracy truly matters — medical or medication information, emergency communications, contractual or financial commitments — do not rely on the captions alone. Always confirm directly, in person or in writing, with the people involved.

The Service is intended to be set up and operated by a family member on behalf of the person who is hard of hearing. Please let the people around you know you are using the Service, and use it with consideration for manners and privacy.

4. Disclaimer

Jimakun is not a hearing aid or medical device, and it does not improve hearing. Caption accuracy can vary depending on background noise, distance from the speaker, clarity of speech, the device's microphone quality, and language settings, and we do not guarantee that captions will always be accurate.

We make no warranty, express or implied, as to the content, accuracy, completeness, or usefulness of the captions displayed by the Service. To the extent permitted by law, we are not liable for any damages arising from a User's use of, or inability to use, the Service, except where such damages arise from our willful misconduct or gross negligence.

5. Prohibited Conduct

Users must not do any of the following when using the Service:

Reverse-engineer, disassemble, or decompile the Service, or otherwise attempt to analyze it
Gain, or attempt to gain, unauthorized access to the Service or our systems
Harass or infringe the rights or privacy of other users or third parties
Copy, repurpose, or sell information obtained through the Service without authorization
Violate any applicable law or public order and morals
Engage in any other conduct that we reasonably consider inappropriate for the operation of the Service

6. Intellectual Property

All copyrights, trademarks, and other intellectual property rights relating to the Service belong to us or to third parties who have duly licensed them to us. The license to use the Service under these Terms does not itself transfer or license any of those intellectual property rights to Users.

7. Changes, Suspension, and Termination of the Service

We may change the content of the Service, or suspend or discontinue it, without prior notice to Users. To the extent permitted by law, we are not liable for any damages arising from such changes, suspension, or discontinuation.

8. Changes to These Terms

We may amend these Terms without prior notice to Users when we consider it necessary. Amended Terms take effect once posted on this page. Continued use of the Service after an amendment constitutes acceptance of the amended Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service.
